If the appellantwishes topresent additionalwitness
testimony, the appellantmust secure aWitness
DeclarationForm from thewitness.TheWitness
DeclarationFormmust be submitted togetherwith
theCitationsAppeals Form andbailwhen the
appeal is filed.Declaration forms are available at the
TMCCPDdesk.Witness declaration formswill not
be accepted after the appeal has beenfiled.
Upon receipt of theCitationAppeals Form,
TMCCPDwill advise the appellant of ahearing
date, location, and time.Thehearingwill usuallybe
scheduledwithin30days after theCitationAppeals
Form is submitted.The appellant doesnot have to
appear at thehearing.Attendance is optional.
Upon receipt of an appeal, TMCCPD shall perform
an initial appeals review.This reviewwill occur
within twobusiness days after receipt.
ATMCCPD supervisor has the authority to take
two courses of action.The supervisormay:
1. Immediatelydismiss a citation for avalid reasonor
2. Forward the appeal to theHearingOfficer for
If the supervisor dismisses the citation, the
TMCCPDwill notify theCashier’sOffice to initiate
a refund to the appellant anyoutstandingbail
Theonly recognizedvalid reasons for dismissal are:
1. Meter out of order (must beverifiedbyTMCCPD)
2. Handicappedpermit orplacard–not visible (maybe
usedonlyone timeper academic year)
3. Citingofficer ordepartment error
4. Official guest of the college (requireswritten request
from college administrator)
TMCC shall appoint aHearingOfficer.TheHearing
Officer shall schedulehearings once eachmonth at
dates and times,which are consistentwithusual and
TheHearingOfficer shall review/hear the
individual’s appeal; consider any additionalwitness
declarations; review theCitationAppeals Form,
render his/her rulings immediately, and submit
theproper paperwork todisposeof thematter.The
HearingOfficer’s ruling is final.
TheHearingOfficer has the authority todismiss
citations for those reasons listed inSection#806 -
Officermaynot reduce the scheduledbail or
Hearings shall beopen to thepublic. Individual
hearings are limited to tenminutes in length.
No sworn testimony shall be taken.Novideoor
audiotape record shall bemadeormaintained.
The appellantmaymake a verbal presentation.
No additional appellantwitness testimonywill be
TMCChasno authority to reviewor dismiss these
citations.Appellantsmust contact the appropriate
jurisdiction toobtain further information.
Article IX -ParkingCitationPenalties
Citationsmust bepaid in fullwithin15days of the
dateof the citation.
Parking citations shall be increased in the sumof
$10.00 if not paidwithin15days, and increase in the
sumof an additional $10.00 if not paidwithin30
Example: If a citation is issuedon01/01, the violator
has until 01/15 topay thepostedbail amount.
Between01/16 and01/30, the violatormust pay
thebail amount plus an additional $10.00penalty.
Commencing01/31, the violatorwill pay an
additional $10.00,which equals $20.00more than
theoriginal bail amount (e.g., $25+$10+$10=
